Individuals issued a trespass warning have the right to object to the issuance of the warning. The first
step to the objection is to request a Trespass Formal Hearing by completing a Trespass Formal Hearing
Request Form. A formal hearing will follow the procedures outlined below.
The recipient of a trespass warning may appeal the outcome of the Formal Hearing.
INSTRUCTIONS
- The Trespass Formal Hearing Request Form must be submitted to the department director of the issuing
department (located on the Trespass Warning issued) within seven (7) days from the date the
trespass warning was served.
- The Trespass Formal Hearing Request Form may be submitted electronically to
DPSS-Trespass-Appeal@umich.edu or by mail to address of the issuing department (located
on the Trespass Warning issued).
- Upon receipt of the formal hearing request, the issuing department will contact the petitioner
within 14 days to schedule the date, time, and location of the hearing.
CONSIDERATIONS
- In general, a trespass warning will not be modified or rescinded if a criminal matter is pending
adjudication.
- Typically, a formal hearing will not be granted for a second or subsequent violation.
- The trespass warning remains in effect during the formal hearing process.
- Refusal to remain on scene to hear the warning or refusal to accept the issued form will be
considered when deciding to uphold, modify, or dismiss the warning.
- An individual may bring an attorney or another support person to the formal hearing. All
objections will be considered.
OUTCOME OF FORMAL HEARING
- The department director may uphold, modify, or rescind the trespass warning and will provide the
petitioner notice of the decision in writing within 14 days of the hearing.
- The recipient of a trespass warning may appeal the outcome of a formal hearing if the
individual can demonstrate a change in circumstances. To appeal the formal hearing outcome, the
Trespass Appeal Request Form must be delivered or postmarked within 21 days of the formal hearing.
